Buyer – natural person/legal entity or any legal entity that creates an account on the Site and places an Order.

User – The Site can be accessed free of charge, and simply browsing its pages does not require user registration. However, to benefit from certain services offered by the site, as well as to purchase the products it offers or to check the status of your orders, you will need to register as a user. Registration as a user implies prior acceptance of the terms and conditions of use of depozituldesaltele, a registered trademark of SC KA&MA TRADING SRL, and its privacy policy. These regulations form the contractual basis of the relationship between users and the company. Nickname – a pseudonym by which a certain User/Client/Buyer can add Content to the Site. The nickname is associated with the User/Client/Buyer's information on the Site under the name "Username."

Client – a natural person/legal entity who has or obtains access to CONTENT, by any means of communication made available by SC KA&MA TRADING SRL (electronic, telephone, etc.) or based on an existing usage agreement between SC KA&MA TRADING SRL and them and which requires the creation and use of an ACCOUNT.

Goods and Services – any product or service, including documents and services mentioned in the Order, to be provided by the Seller to the Buyer as a result of the concluded Contract.

Order – an electronic document acting as a form of communication between the Seller and the Buyer by which the Seller agrees to deliver the Goods and Services, and the Buyer agrees to receive these Goods and Services and make payment for them.

Campaign – the act of exhibiting, for commercial purposes, a finite number of Goods and/or Services with a limited and predefined stock, for a fixed period of time by the Seller.

Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer to place an Order and which contains information about the Client/Buyer and the Buyer's history on the Site (Orders, tax invoices, Goods warranties, etc.).

Contract - represents the distance contract according to the definition included in GEO 34 of June 4, 2014, concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

Content - all information on the Site that can be visited, viewed or otherwise accessed using an electronic device;

the content of any email sent to Buyers by the Seller by electronic means and/or any other available means of communication;

  • any information communicated by any means by an employee/collaborator of the Seller to the Buyer, according to the contact information, whether specified or not;
  • information related to the Goods and/or Services and/or tariffs applied by the Seller or by a third party with whom the Seller has concluded partnership agreements, for a certain period;
  • data relating to the Seller or other privileged data of the Seller.

Intellectual Property Rights - the content and design of SC KA&MA TRADING SRL -depozituldesaltele, as well as any other related material sent by you via email or provided by any other means, belong to the company and/or its collaborators - where expressly specified (copyright) and are protected by intellectual property law. You may not use, reproduce or allow anyone to use or reproduce depozituldesaltele materials, nor may you use frames for trademarks, logos or other information protected by copyright law without the prior written permission of the company.

Review - a written evaluation by the owner or beneficiary of a product or service, an evaluation based on personal experience and its ability to make qualitative comments and to say whether the product or service meets the specifications mentioned by the manufacturer, as long as its content is not illegal, obscene, threatening, defamatory, does not infringe the right to privacy or intellectual property law; it does not contain computer viruses, commercial or political communications that incite hatred or intolerance.

Comment – an evaluation or critical observation, on the part of a review or another comment.

Question – the form of addressing other Users/Clients/Buyers in order to obtain information about products or services on that page.

Answer - written information sent to the User/Client/Buyer who asked a Question on the Site, on the page of a specific product. An answer is an explanation given by a User/Client/Buyer to another User/Client/Buyer in a discussion.

Document - these Terms and Conditions.

Newsletter – a means of periodic, exclusively electronic, information, namely electronic mail (e-mail, SMS) about Goods and Services and/or promotions carried out by the Seller for a certain period, without any commitment from the Seller with reference to the information contained therein.

Transaction - the collection or refund of an amount resulting from the sale of a Good and/or Service by Depozitul de Saltele to the Buyer, through the use of the services of the card processor agreed by the Seller, regardless of the delivery method.

Specifications – all specifications and/or descriptions of the Goods and Services as specified in the Order.

  1. GENERAL CONDITIONS

Placing an order with SC KA&MA TRADING S.R.L constitutes your agreement to the terms and conditions of this Document.

The information provided to SC KA&MA TRADING SRL is used only for the purpose for which it was entered (placing orders), in accordance with current laws. SC KA&MA TRADING SRL does not provide your email address to third parties, does not encourage spam, and does not make public the data provided by its customers without their explicit consent. Any user has the possibility to delete the provided email address from the database.

The prices displayed on the website are expressed in RON and include VAT (21%). Unless otherwise stated, the prices of products displayed on depozituldesaltele represent the final purchase prices and include VAT (value-added tax of 21%, valid in Romania). Final purchase prices may be suggested by manufacturers or suppliers or may be estimated based on standard prices applicable in the commercialized product industry. Final purchase prices may not represent the most competitive prices in a particular product segment or for a particular period. Discounts, rebates, and promotions are not cumulative. The discount with the highest value is always retained. We reserve the right to change discounts, rebates, and promotions without prior notice.

For the purchase of custom-made products, an advance payment of at least 50% of the product value may be requested.

The price, payment method, and payment term are specified in the order. SC KA&MA TRADING S.R.L will issue an invoice to the Buyer for the delivered Goods and services, and the Buyer's obligation is to provide all necessary information for issuing the invoice in accordance with current legislation. This information is necessary for the correct and efficient processing of your order. Please fill in the form correctly and indicate the persons for whom the billing and delivery are made. The email address is extremely important because information related to the order and the ordered products will be sent via email. An incorrect email address slows down the entire ordering process. Moreover, the Company will not be able to contact you and inform you about the status of your order. If the delivery address is not the same as the billing address, please indicate this. Otherwise, we reserve the right to cancel incomplete orders or orders placed without basic information (e.g.: buyer's name, contact phone number, email address, delivery address, billing address, payment method).

In the event that a product is listed at an incorrect price or with incorrect information due to typographical errors or pricing errors or product information, we reserve the right to refuse or cancel any order placed for products that contain the error. We shall have the right to refuse or cancel any order whether or not it has been prepaid. In this case, money will be refunded as soon as possible. In the case of Goods that undergo modifications at the Buyer's request (e.g., atypical dimensions for mattresses: width, length, height, etc.), the return of the Goods is not accepted.

The products sold through www.depozituldesaltele.ro are new, sold in their own packaging or repackaged (in which case the reason for repackaging is clearly mentioned) and at the time of delivery they are accompanied by the tax invoice and warranty certificate.

SC KA&MA TRADING SRL reserves the right to refuse cooperation with clients who display inappropriate behavior and language (aggressive, licentious, etc.) or have refused deliveries in their order history.

Products sold by www.depozituldesaltele.ro can only be delivered based on an online order or at the depozituldesaltele store in Timisoara. Online orders do not require product reservation. Online orders will be fulfilled in the chronological order in which they were registered by the system. An order containing a product with the status: In Stock, cannot be fulfilled if another order was registered for the same product before it chronologically and subsequently confirmed, thus depleting the stock.

  1. ONLINE SALES POLICY

Access to place an Order is permitted to any Client/Buyer.

For justified reasons, KA&MA TRADING SRL reserves the right to restrict the Client/Buyer's access to placing an Order and/or to some of the accepted payment methods, if it considers that, based on the Client/Buyer's behavior or activity on the Site, their actions could harm KA&MA TRADING SRL in any way. In any of these cases, the Client/Buyer can contact the Customer Relations Department of KA&MA TRADING SRL to be informed about the reasons that led to the application of the measures mentioned above.

Communication with the Seller can be done through direct interaction with them or through the addresses mentioned in the "contact" section of the Site. The Seller is free to manage the information received without having to provide justifications for it.

In the case of online payments, the Seller is not/cannot be held responsible for any other additional costs incurred by the Buyer, including, but not limited to, currency conversion fees applied by the issuing bank of the card, if its issuing currency differs from RON. The Buyer is solely responsible for this action.

All information used to describe the Goods and/or Services available on the Site (static/dynamic images/multimedia presentations/etc.) does not represent a contractual obligation on the part of the Seller, as they are used exclusively for presentation purposes.

  1. CONTRACTUAL DOCUMENTS

By placing an electronic or telephone order on www.depozituldesaltele.ro, the Buyer agrees to the form of communication (telephone, chat or e-mail) through which SC KA&MA TRADING SRL carries out its operations.

The order is comprised as follows: clear details regarding delivery and billing data, its specific conditions; Buyer's specifications (where applicable); the notification received by the Buyer after placing the Order serves as information and does not represent acceptance of the Order. This notification is made electronically (e-mail) or by telephone.

If the Seller confirms the order, this will imply full acceptance of the terms and conditions of the order by the Buyer. The Seller's acceptance of the order is considered finalized when there is a verbal or electronic confirmation from the Seller to the Buyer, without the need for an acknowledgment of receipt from the Buyer.

This Agreement enters into force upon confirmation of the order by the Seller. Confirmation is made by telephone, electronically or verbally. The general terms and conditions of sale will form the basis of the Contract thus concluded, in addition to which there will also be the Warranty Certificate issued by SC KA&MA TRADING SRL.

For justified reasons, the Seller reserves the right to modify the quantity of Goods and/or Services in the Order. If it modifies the quantity of Goods and/or Services in the Order, it will notify the Buyer at the e-mail address or phone number provided to the Seller when placing the Order and will return the paid amount.

The contract is considered concluded between the Seller and the Buyer when the Buyer receives from the Seller, by e-mail and/or SMS, the notification of shipment of the Order.

  1. ORDER

The Client/Buyer can place Orders on the Site by adding the desired Goods and/or Services to the shopping cart, and then completing the Order by paying through one of the indicated methods. Once added to the shopping cart, a Good and/or Service is available for purchase as long as there is available stock for it. Adding a Good/Service to the shopping cart without completing the Order does not result in the registration of an order, implicitly not the automatic reservation of the Good/Service.

By completing the Order, the Buyer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true on the date of placing the Order, and the Seller can contact him, by any means available/agreed by him, in any situation where it is necessary to contact the Buyer.

The Seller may cancel the Order placed by the Buyer, following prior notification to the Buyer, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other in the following cases:

- non-acceptance by the Buyer's card issuing bank of the transaction, in case of online payment;

- the data provided by the Client/Buyer on the Site are incomplete and/or incorrect;

In the event that the Client/Buyer requests to withdraw from the Contract within the legal withdrawal period, they must also return any gifts that accompanied the respective product. If the Order is paid, the Seller will refund the amount within a maximum of 14 (fourteen) days from the date the Buyer informs the Seller of their decision to withdraw from the Contract. The amount will be refunded as follows: - for Orders paid by Op/Cash on Delivery/Bank Card -> by bank transfer;

Some products benefit from certain discounts/bonuses when purchased in the same order together with another product. These discounts can also be seen in the order confirmation received by the customer and are distributed in value across the basket of products included in the promotion.

The promotion is valid only if the customer keeps the order with the initially chosen product package. If you waive one of the products in the package, the promotion will no longer be kept and the applied discount will be canceled. The product for which the customer retains the order option returns to its full price, which will be the price paid at the time of fulfilling the order.

In the event that a client wishes to return a product that benefited from a discount or generated an additional bonus at the time of purchase, by placing it in the order in association with other products, the following money refund rules will apply:

5.1 The money will be refunded within a maximum of 10 days from the date of notification of the return decision, into the bank account provided by the customer in the return form.

5.2 Because the product was part of a promotion, only by association with the other products, the discounts/bonuses offered in the initial order are canceled. The prices of the products kept by the client revert to the value before the application of the discount, a discount obtained by combining the order with the product to be returned. The amount to be refunded to the client is equal to the difference between the value paid by the client and the initial price of the products kept (without the discount applied for the quantity of products).

The Seller will be able to postpone the refund of the amount until the sold Goods are received or until proof is received that they have been shipped, in case they have not offered to retrieve the Goods themselves (the latest date will be taken).

In the event that a Good and/or Service ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Client/Buyer about this fact and will return to the Buyer's account the value of the Good and/or Service, within a maximum of 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed their intention to terminate the Contract.

5.3 Card payment

Online with bank card through EuPlatesc (Visa/Visa Electron/Maestro/MasterCard).

If you have chosen the "Online by bank card" payment method, you need to fill in a form with your card information on the payment processor's secure page.

- Credit/debit card payments issued under the Visa and MasterCard logos (Visa/Visa Electron and MasterCard/Maestro) are made through the "3-D Secure" system developed by organizations that ensure online transactions have the same level of security as those carried out at an ATM or in a physical environment, at the merchant.

- "3-D Secure" primarily ensures that no information related to your card is transferred or stored, at any time, on the store's servers or on the payment processor's servers, this data being directly entered into Visa and MasterCard systems.

5.4 Online in equal installments without interest using a shopping card

After you enter the card number on the payment processor's page, the system will automatically detect if it is a card eligible for installment payment, with one of the banks agreed by the store, and will display a list from which you can choose the desired number of installments (credit card issued by Banca Transilvania, BCR, BRD Finance, Alpha Bank).

  1. INTELLECTUAL PROPERTY RIGHTS

The content of the website www.depozituldesaltele.ro, as defined in the preamble - texts, images, web graphics, scripts, programs, databases, as well as materials subject to email communications - belongs to SC KA&MA TRADING SRL, being protected by copyright law and that of intellectual and industrial property rights.

The Client/Buyer is not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any Content in any context other than that originally intended by Depozitul de Saltele, include any Content outside the Site, remove signs signifying KA&MA TRADING SRL's copyright over the Content, as well as participate in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the Content, except with the express written consent of KA&MA TRADING SRL.

The Client/Buyer may copy, transfer and/or use the Content only for personal or non-commercial purposes, only if these do not conflict with the provisions of the Document.

The use or reproduction of any of the elements listed above, without the prior written consent of SC KA&MA TRADING SRL, is punishable according to current laws.

Any attempt of any kind to modify the image and information on this website www.depozituldesaltele.ro, except by its legal owner - SC KA&MA TRADING S.R.L, without the prior consent of SC KA&MA TRADING S.R.L, grants SC KA&MA TRADING S.R.L the unilateral and unequivocal right to use all its prerogatives to address the competent courts for the sanctioning of such acts.

Any use of the Content for purposes other than those expressly permitted by this Document or by the accompanying usage agreement, if any, is prohibited.

  1. RIGHTS AND OBLIGATIONS OF THE SELLER

The Seller will use its professional and technical knowledge to obtain the result stipulated in the order and will deliver the goods and services that meet the Buyer's requirements, needs and specifications;

The information presented on the seller's websites is for informational purposes only and may be modified by the seller without prior notice. Also, for reasons related to space and the coherence of the information structure, product descriptions may be incomplete, but the seller makes efforts to present the most relevant information, so that the product can be used within the parameters for which it was purchased. Product images are also informative and there may be differences between them and the actual product;

Communication with the store – can be done through interaction with it, posting opinions regarding products or communicating through the addresses mentioned in the "Contact" section. Opinions or addresses containing insults or inappropriate language will be excluded from the site or ignored. The seller is free to manage the received information without having to provide justifications for this.

S.C. KA&MA TRADING S.R.L. may assign and/or subcontract a third party for services related to order fulfillment, with the Buyer's notification, without requiring their consent. The Seller will always be responsible to the Buyer for all contractual obligations (choosing the company that will carry out the delivery).

  1. TRANSFER OF OWNERSHIP

The ownership of the Goods and Services will be transferred at the time of payment by the Buyer at the location indicated in the order (understood as delivery - signature of receipt of the transport document provided by the courier or signature of receipt on the tax invoice in the case of deliveries made by SC KA&MA TRADING SRL personnel).

The client is obliged to check that the packaging is not torn, that it does not show traces of scratches, dents, stains upon receipt of the product and may refuse the product if it shows signs of improper handling and draw up a verbal report with the courier representative.

  1. DELIVERY OF GOODS

The Seller undertakes to deliver the Goods using a courier system, will ensure appropriate packaging of the Goods and will ensure the transmission of accompanying documents.

Shipping costs start from 35 lei and increase depending on the number of products ordered (can reach up to a maximum of 280 lei). An additional fee of 10 lei is added for cash on delivery orders.

  1. ACCEPTANCE

Acceptance will occur when the goods and services comply with the technical characteristics mentioned in the order. If the buyer finds that the delivered products do not comply with the technical specifications, then the seller will bring the products and services into compliance. Also, for products sold and delivered by SC KA&MA TRADING SRL, through the website www.depozituldesaltele.ro, the Buyer benefits from returning the products within 14 days. Regardless of the product return period, the customer has the obligation to notify in writing at the email address office@depozituldesaltele.ro any defect within a maximum of 5 days from the receipt of the products. When the customer receives the product, they have the obligation to check the integrity of the package packaging in the presence of the courier agent. If the package is damaged upon delivery, the customer has the obligation to refuse its receipt and to specify in the comments of the verbal report drawn up with the agent the condition of the package at the time of delivery.

The client is obliged to check the integrity of each element before assembly and not to assemble the product if they find defects in the product or its elements. Assembling the product under these conditions entails the loss of warranty.

  1. PRODUCT WARRANTY

All products sold by www.depozituldesaltele.ro benefit from warranty conditions according to current legislation and the commercial policies of the manufacturers. The products are new, in their own packaging.

All products sold and delivered are accompanied by the warranty certificate issued directly by SC KA&MA TRADING SRL. The warranty certificate contains general usage instructions and warranty conditions.

The absence of the product's warranty certificate must be reported within 48 hours of receiving the goods, at office@depozituldesaltele.ro. Any subsequent notification will not be considered.

The Buyer is obliged to keep the warranty certificate and the tax invoice. In case of defect, according to Law no. GEO 140/2021, the warranty certificate is the only document that certifies the right to warranty and will be presented together with the tax invoice and proof of payment (receipt, tax receipt, etc.). Loss of the warranty certificate results in the cancellation of the warranty for the Good or Service.

The warranty for Goods, which benefit from the Warranty Certificate issued by SC KA&MA TRADING SRL, is settled at the company's workplace, str. Principala, no.200, Buzias, and the warranty conditions are in accordance with GEO 140/2021.

For any category of products, the following are strictly prohibited:

- assembling the product if damage to an element or the product itself is found;

– unpacking using sharp or hard objects; cutting or scratching materials;

– rubbing against other surfaces or with abrasive substances (cleaning solutions);

- use or storage of products in humid environments or at temperatures below 0 degrees Celsius as well as in environments with temperature variations;

– placing the product near heat sources; wetting products; rolling, bending or curving mattresses during transport and handling;

The warranty is settled within a maximum of 15 calendar days.

  1. RETURN POLICY

According to Romanian legislation, you can return products purchased from www.depozituldesaltele.ro within 14 calendar days of receipt, without needing to justify the return decision and without incurring any costs other than the direct costs of returning the products, in accordance with Government Emergency Ordinance no. 34/2014 regarding consumer rights in contracts concluded with professionals.

  • Terms and conditions for returning products

The client must request in writing that they wish to return the purchased products by email to: office@depozituldesaltele.ro and complete the Return Form on the website.

The return cost is fixed for each product in the order. Depending on the product category, a cost is charged as follows:

- Mattresses: 150 RON

- Toppers: 55 RON

- Pillows/Duvets: 35 RON

- Decorative pillows: 15 RON

- Click-clack sofas: 150 RON

- Mattress covers/Bedding/Mattress protectors: 30 RON

In addition to the fixed return cost charged by SCKA&MA TRADING SRL, a fixed cost per kilometer is charged by the courier agency for destinations outside the courier agency's service area.

The product will be picked up exclusively by the courier company's agents from the customer's address, within a maximum of 3 working days.

The response time for return requests is 3 working days from the moment of registration.

  1. GENERAL RETURN CONDITIONS

The consumer has the right to notify the merchant in writing that they withdraw from the purchase, without penalties and without invoking a reason, within 14 working days from the receipt of the product or, in the case of services, from the conclusion of the contract, in accordance with the provisions of article no. 4 letter b of GEO 34/2014.

If a product offered by SC KA&MA TRADING SRL is different from its description on the Site, you can return it in accordance with the Site's product return policy and in accordance with current Romanian legislation. Products must be returned in new product condition, in their original, undamaged packaging, in working order, and accompanied by all accessories (including hardware), original documents (tax invoice, fiscal receipt, technical sheet, user manual, warranty certificate), well packaged and protected during transport.

If the returned product is damaged, has stains, signs of assembly, excessive wear or use, scratches, punctures, dents, is dirty or has missing hardware and cannot be sold as new, we reserve the right to charge a fee to cover the price difference between a new product and an already used product, or if it is in a condition that does not allow us to remarket it, we reserve the right to refuse the product. In case of refusal, the shipping costs for return are the responsibility of the sender.

The refund will be made within a maximum of 10 days from the date of notification of the return decision, into the bank account provided by the customer in the return request email.

Custom-made products in atypical dimensions cannot be returned. These products were specially created for you. By custom-made products, we mean any product that has been personalized according to the customer's preferences (size: length, width, height; surface material - by specifying a material code or any other modification from the standard model presented on the product page on the www.depozituldesaltele.ro website), in accordance with article 16, letter c, of Emergency Ordinance no. 34/2014.

In the event that the customer wishes to exchange the returned product for another product, please mention this in an email to office@depozituldesaltele.ro. The returned product must comply with the terms and conditions for product returns, in accordance with current Romanian legislation.

If the new product has a higher price, the customer will pay the difference, and if the price is lower, SC KA&MA TRADING SRL will refund the price difference (within 14 days from the date of receipt/receipt of the product) to the communicated IBAN account in advance. In case of modification, the delivery time for the new product is established by mutual agreement with the customer. Depending on availability, the delivery time for the new product can be between 1 and 4 weeks from the moment the returned product is received.

  1. PRODUCT VERIFICATION

Upon receipt of the package, please check the integrity of the packaging. If the packages have damaged packaging upon receipt, it is mandatory to draw up a Verbal Report with the courier agents, noting the delivery with damaged packaging or refusing receipt.

On our website, returning a product is done in a few simple, quick, and hassle-free steps.

Our product return policy starts from the day the product arrived at the address specified in the order.

If, for any reason, you are not 100% satisfied with a product you purchased, you can return it within 14 calendar days from the moment you took possession of it, according to GEO 34/2014. Products can only be returned in the same condition in which they were delivered. The returned product must be in the same condition in which it was delivered. If the product does not match the one in the order or has manufacturing defects, the product replacement or return is free, and if you ordered the wrong product or simply changed your mind and no longer want the product, the return shipping costs will be borne by the customer. The maximum legal term for refunding the product value is 14 days, but we assure you that we will refund the money within a maximum of 10 calendar days from the receipt of the package. Refunds are only made to a bank account.

If the product is returned in a condition that it can no longer be sold as new, we reserve the right to refuse payment for the product to the client or, at the client's option, we will reship the product to them at their expense.

This clause applies in accordance with GEO 34/2014, in the case of purchasing products from this site using distance communication techniques, applying the definitions contained in GEO 34/2014.

You can request a product return in the following cases:

  • You simply changed your mind or no longer like the product. The product must be returned as new, in its original packaging, not torn, cut, or washed with bleach, etc.
  • The delivered product does not match the specifications on the website. We guarantee the quality of our products. Products can be machine washed at temperatures of maximum 30 degrees and without using bleach. However, if they fade, you can request a return for replacement or a full refund.
  • Wrong products delivered. If the product or material type was incorrect. For example, if a 100% cotton, red, and a specific print product was ordered, but you received a product made of synthetic fiber, a different color, and a different print. Return costs are borne by our store.
  • If the product has manufacturing defects. In this situation, we will replace the product free of charge or accept the return and provide free shipping.

The consumer has the right to notify the merchant in writing that they renounce the purchase, without penalties and without invoking a reason, within 14 calendar days from the receipt of the product.

The product you are returning must be in the same condition in which it was delivered, in its original, undamaged packaging. Products that are torn, damaged, machine washed or bleached, and/or any other cases where the product can no longer be resold as new are not accepted for return.

Mattress and topper returns

On our website, returning a product is done in a few simple, quick, and hassle-free steps.

Our product return policy starts from the day the product arrived at the address specified in the order.

If, for any reason, you are not 100% satisfied with a product you purchased, you can return it within 14 calendar days from the moment you took possession of it, according to GEO 34/2014. Products can only be returned in the same condition in which they were delivered. The returned product must be in the same condition in which it was delivered. If the product does not match the one in the order or has manufacturing defects, the product replacement or return is free, and if you ordered the wrong product or simply changed your mind and no longer want the product, the return shipping costs will be borne by the client. The maximum legal term for refunding the product value is 14 days, but we assure you that we will refund the money within a maximum of 10 calendar days from the receipt of the package. Refunds are only made to a bank account.

If the product is returned in a condition that it can no longer be sold as new, we reserve the right to refuse payment for the product to the client or, at the client's option, we will reship the product to them at their expense.

Mattresses can be returned within 14 working days from the date of purchase under the following conditions and at the customer's responsibility:

  • The product must be in the same condition in which it was delivered and accompanied by the accessories or gifts with which it was delivered.
  • The product must be very well packaged, we recommend using two layers of polyethylene film, sealing the corners with scotch tape and using cardboard corner protectors. We do not accept products packaged in stretch film or non-woven fabric. We reserve the right to refuse packages if they are not very well packaged.
  • If you bought several products of the same model, even if different sizes, and want to return all of them, make sure that only one has been unsealed.
  • It must not show damage caused by improper handling.
  • They must be accompanied by all received documents (invoice, receipt, warranty certificate, etc.).
  • The shipping cost for return is exclusively borne by the buyer. The responsibility for the integrity of the package throughout transport rests solely with the sender, as the package must be thoroughly packed, exactly as upon delivery, the responsibility for the integrity of the package rests with the sender.

Mattresses of atypical dimensions or those produced according to customer specifications, which are subject to a special order, cannot be returned.

IMPORTANT!

  • In case the product, regardless of the cause of the return, arrives at the seller: with torn textile or foam/sponge, dirty or stained, hair or odors of any kind or damaged in any way during transport, we reserve the right to refuse the package.
  • In the situation where the damages, defects or flaws mentioned above are hidden inside the package and cannot be observed at the time of receipt of the package, according to GEO 34/2014, we reserve the right to reduce the refunded amount, but not more than 25% of the value found on the purchase invoice.
  • Damages found after opening the package will be communicated to the consumer within a maximum of 24 hours from the date of receipt of the package, by sending photos/videos, by email or WhatsApp.
  • Also, packages with payment on delivery will not be accepted. They will be refused.
  • You can only return products together with all attached documents.
  • The return shipping address is the same as the one from which the product was shipped; unless another is requested.
  • The products marked on the return form must be handed over in full to the courier, exactly as they were ticked on the site when requesting the return. If the return package contains products different from those in the completed form, after the courier verifies the package, the pickup will be refused.

After registering the return request, you will receive a telephone or email confirmation within a maximum of 48 hours, after which you can ship the product.

Also, we will notify you as soon as your return arrives at the warehouse, where the condition of the package will be checked.

After validating the package condition, the final solution will be applied (replacement, full or partial refund, or voucher).

The money will be refunded within 10 days from the date we are informed about the decision to withdraw, after receiving the return. You will provide us with a bank account to make the refund, or we can agree, by mutual consent, to replace or exchange the products.

IMPORTANT

  • During the first weeks, turn and lightly tap the mattress to encourage even settling of the filling. A slight sagging of the mattress, no more than 2 cm, is normal and is due to the settling of the filling;
  • Aerate the mattress frequently: it is advisable to perform the operation on dry and sunny days. For good aeration, it is advisable to remove the bedding and possibly the protective cover in the morning so that the mattress remains uncovered;
  • At the moment of opening the mattress and in the following days, the product may emit specific production odors into the environment, these being non-toxic and gradually disappearing during the first period of mattress use;
  • If the environment is humid, turn the mattress twice a month and aerate the mattress repeatedly without exposing it to the sun. The memory foam mattress is used on only one side, with the viscoelastic foam layer facing up to maximize its qualities.
  • We recommend rotating it 360 degrees (feet-head and front-back) if it is without memory foam and 180 degrees for those with memory foam, every 3-6 months.
  • Detachable mattress covers can be cleaned by dry cleaning, chemical cleaning or washable at 30 degrees. Chlorination, steaming and ironing are prohibited. Do not machine wash – wash strictly by hand.
  • For the mattress to fully recover, after unwrapping, 24 hours must pass, sometimes up to 36 hours.
  • The mattress must be unsealed within a maximum of 5 days of receiving the package.
  • Tolerances regarding dimensions are as follows: height +/- 6%, width +/- 3%, length +/- 1.5%.
  • The color of the polyurethane foam does not affect the technical characteristics of the product and does not constitute an obligation of sale.

THE WARRANTY IS NOT VALID IN THE FOLLOWING SITUATIONS:

  • Mold and Stains – automatically void the product warranty
  • Accidental defects, possible unsealing, tears, scratches, tearing of fabric or handles, or any other damage due to external, mechanical or chemical factors.
  • If the maximum allowed weight for one person or cumulatively for several has been exceeded.
  • For reasons related to changes in firmness; if the mattress firmness is perceived differently from the time of purchase. The degree of firmness is subjective and is perceived differently depending on a series of factors.
  • The mattress is improperly stored or assembled, inadequately used or for other purposes, cleaned by improper methods or with unsuitable substances;
  • If the product has come into contact with liquids, once absorbed by the material, they evaporate very slowly, which leads to unpleasant odors or mold;
  • If a slatted base support, with elastic and spaced slats, has not been used.
  • If the product has been folded or subjected to pressing; this treatment leads to the destruction of the material;
  • If the product is very dirty and unkempt: torn, dirty or stained foam or cover, or odors of any kind.
  • If the product has undergone modifications or repairs without authorization, as well as if the rules for use and maintenance of the product have not been observed, the mattress being used as a sofa or any seating object. The mattress is used exclusively for sleeping!
  • If the product shows damage caused by improper maintenance, negligence or other factors;

Loss of the certificate leads to the cancellation of the product warranty.

MATTRESS PACKAGING

We recommend packaging mattresses in polyethylene film with a minimum thickness of 0.10 mm and in two layers (like the one the package was sent in) and with cardboard corners on the edges. The edges of the film must be tightly sealed with adhesive packaging tape - scotch tape, to protect the product from dust.

PACKAGING PILLOWS/DUVETS/COVERS/BEDDING

We recommend packaging pillows and duvets in polyethylene film with a minimum thickness of 0.10 mm and in a cardboard box or in a raffia bag (like the one the package was sent in). The edges of the film must be tightly sealed with adhesive packaging tape - scotch tape, to protect the product from dust.

SOFA PACKAGING

We recommend packaging products in this category in stretch film to protect the product from dust and in polyethylene film with a minimum thickness of 0.10mm, and the hardware and bed frame in the cardboard box in which the product was delivered.

  1. FORCE MAJEURE

Neither party shall be liable for non-performance of its contractual obligations if such non-performance is due to a force majeure event. Force majeure is an unpredictable event, beyond the control of the parties and which cannot be avoided. KA&MA TRADING SRL, its affiliates and/or generally the suppliers of products or services to it, cannot be held liable for any delay or error resulting directly or indirectly from causes beyond the control of KA&MA TRADING SRL. This exemption includes, but is not limited to: errors in the operation of technical equipment, failure of internet connection, failure of telephone connections, computer viruses, unauthorized access to systems, operational errors by KA&MA TRADING SRL as well as force majeure cases provided by current Romanian legislation.

If, within 15 (fifteen) days from its occurrence, the mentioned event does not cease, each party shall have the right to notify the other party of the full termination of the Contract, without either of them being able to claim further damages from the other.

  1. APPLICABLE LAW

The services offered by KA&MA TRADING SRL are governed by the provisions of Romanian law, in particular Law 365/2002 regarding electronic commerce, GEO 34/2014 regarding consumer protection in concluding and executing distance contracts, Government Decision 448/2005 and European Directive CE/96/2002. The terms and conditions of KA&MA TRADING SRL are subject to Romanian legislation. In case of dispute, an amicable solution will be attempted first, within 30 working days from the registration of the complaint at the headquarters of KA&MA TRADING SRL. If an agreement cannot be reached within the aforementioned period, disputes between the parties will be submitted for resolution to the competent courts in the municipality of Timisoara.
